Liability Waiver & Acknowledgment of Responsibility

I, the undersigned, understand and agree to the following terms in relation to the training services provided by Jordan Holdsworth, hereinafter referred to as Flourish and Barks:

1. Training Safety & Methods 
Flourish and Barks will make every reasonable effort to create a safe and structured environment for the training of my dog. All instruction and handling techniques used will be sound, responsible, and based on the current best practices of positive reinforcement dog training.

2. Trainer Liability Disclaimer 
I acknowledge that Flourish and Barks shall not be held liable for any unintentional errors, omissions, or misstatements made during the training process. I understand that dog behavior can be unpredictable and that success is not guaranteed.

3. Responsibility for Products or Third-Party Services 
I understand that any recommendations made by Flourish and Barks regarding products, equipment, veterinary services, or other pet-related services are made in good faith and do not constitute a guarantee or warranty of satisfaction or results.

4. Client Responsibility for Training Outcomes 
I understand that the effectiveness of any training program depends largely on my commitment, consistency, and timely implementation of the trainer’s instructions and recommendations. Flourish and Barks cannot be held responsible for outcomes resulting from a lack of client follow-through.

5. Ongoing Responsibility for My Dog’s Behavior 
I agree that I am and shall remain solely responsible for the behavior, actions, and safety of my dog at all times. I agree to indemnify and hold harmless Flourish and Barks and its agents or representatives from any and all claims, losses, injuries, damages, or expenses (including but not limited to veterinary bills, property damage, legal fees, or the injury or death of any person or animal) caused by my dog while in training or under my care.

6. Risk Acknowledgment 
I acknowledge that owning and working with dogs carries inherent risks, including the risk of dog bites, property damage, or injury to myself or others. I voluntarily assume all risks associated with participation in training sessions.

7. Disclosure of Dog’s History 
I understand that full disclosure is critical to the safety and success of training. I confirm that I have provided complete and accurate information regarding my dog’s behavioral history, medical conditions, and any known tendencies such as aggression, fear, anxiety, or reactivity. I accept all responsibility for any consequences resulting from the omission, withholding, or inaccuracy of such information.

Injury, Illness, or Death Release

While Flourish and Barks makes every reasonable effort to provide a safe, controlled, and attentive environment for all dogs in its care, I understand that unforeseen incidents, medical emergencies, or accidents can occur, even with trained professionals and proper precautions in place.

I acknowledge and accept the inherent risks associated with dog handling, training, transport, and interaction with the environment or other animals. I understand that Flourish and Barks is not a veterinary facility and does not provide veterinary care or emergency medical services.

In the rare event of illness, injury, or untimely death of my dog while in the care of Flourish and Barks, I agree not to hold the trainer, business, or any representatives liable, provided that reasonable care and supervision were exercised.

I release and hold harmless Flourish and Barks from any and all claims, liability, or damages related to accidental injury, illness, escape, or death of my dog while participating in training services, transportation, or in the trainer’s custody, unless caused by proven gross negligence or intentional misconduct.

Emergency Veterinary Care Authorization

In the event of a medical emergency while my dog is in the care of Flourish & Barks, I authorize the trainer to seek immediate veterinary care on my behalf. I understand that every effort will be made to contact me or my designated emergency contact prior to treatment. I agree to be responsible for all resulting veterinary costs, regardless of the outcome.

Transportation Waiver

I understand that if my dog is transported by Flourish & Barks for any reason (including pick-up/drop-off for training), they will be safely secured using a crate or dog seatbelt restraint. I accept all risk associated with transportation and release Flourish & Barks from any liability resulting from transport-related incidents, except in cases of proven gross negligence.

Vaccination Requirement

I agree to provide proof of current core vaccinations (including Rabies, DHPP, and Bordetella) prior to the start of any training service. I understand that services may be denied or postponed if up-to-date vaccination records are not submitted in advance.

No Guarantees Disclaimer

I understand that while Flourish & Barks uses effective and humane training techniques, the success of any training program cannot be guaranteed. Each dog is an individual, and outcomes may vary based on consistency, environment, previous history, and owner participation.

Right to Modify or Terminate Services

Flourish & Barks reserves the right to modify or terminate training services at any time if it is determined that continuing would be unsafe for the dog, trainer, or others, or if the client fails to comply with the training plan or policies outlined in this agreement. Any unused pre-paid services will be refunded on a prorated basis, less any applicable fees.

Governing Law & Dispute Resolution

This agreement shall be governed by and interpreted in accordance with the laws of the State of Texas. In the event of any dispute arising from this agreement, the parties agree to first attempt resolution through informal communication. If unresolved, both parties agree to enter into mediation before pursuing legal action.

Media and Photo Release

I understand and agree that during the course of training, my dog may be photographed or recorded by Flourish and Barks for documentation, educational, or promotional purposes. These images or videos may be used in, but are not limited to: social media content, website and marketing materials, training demonstrations, or printed promotional materials.

By signing this agreement, I grant Flourish and Barks the perpetual, royalty-free, and unrestricted right to use, reproduce, and publish any media (photos, videos, or audio recordings) that include my dog. I understand that my personal identity (such as my name, face, or home location) will never be shared without my additional, express written consent.

I waive the right to inspect or approve the final media and release Flourish and Barks from any claims, liabilities, or damages related to the use of such materials.

If I prefer to opt out of media use, I will notify Flourish and Barks in writing prior to the start of training.

Payment & Cancellation Policy

Payment for all training services is due in full prior to, or at the time of service, unless otherwise agreed upon in writing. Services will not be rendered without receipt of payment. Accepted payment methods will be outlined at the time of booking.

Cancellations or rescheduling requests must be made at least 24 hours in advance of the scheduled service time. Appointments canceled with less than 24 hours' notice are subject to a cancellation fee equal to 50% of the scheduled service rate.

Failure to provide payment or repeated last-minute cancellations may result in forfeiture of future training sessions or refusal of service.

By booking services with Flourish & Barks, the client agrees to these payment and cancellation terms.
